Debt recovery in Victoria
Infexcel Recoveries is based in Melbourne's legal precinct on Little Collins Street, so Victorian clients can meet us in person when a matter needs it.
Where claims are heard
Undefended and smaller civil debt claims in Victoria are generally commenced in the Magistrates' Court of Victoria; larger claims proceed to the County Court or Supreme Court. Some consumer and tenancy matters belong in VCAT.
Time limits
Under the Limitation of Actions Act 1958 (Vic) most simple contract debts must be sued on within six years of the cause of action arising. This is general information, not legal advice; limitation rules have exceptions and the clock can be affected by acknowledgments or part-payments.
Local notes
- Melbourne's construction and trades sector generates many security-of-payment disputes; we coordinate with practitioners experienced in the Building and Construction Industry Security of Payment Act 2002 (Vic).
- Rental arrears for Victorian residential tenancies are subject to the Residential Tenancies Act 1997 and VCAT procedures.
